2. When ProClick is a controller and when it is a processor

For website visitors, demo requests, client account administrators and our commercial relationship with a client, ProClick generally acts as a data controller. For customer conversations, product-catalogue data and other client data processed through a proClick AI product, the client business generally decides why and how that data is used and is the controller; ProClick acts as that client’s processor or service provider under the applicable agreement and the client’s instructions.

If you interacted with a business through one of its connected channels or services, that business is your main point of contact for questions about its customer relationship with you.

3. Data we may process

Depending on the product, feature and channel, this may include:

work email, company website and other information submitted in a demo request;
client user and workspace information, connected-service settings and authorisation records;
Page and channel metadata, including information needed to operate a client-authorised Meta Messenger connection;
messages, attachments, conversation identifiers, timestamps, customer-service status and handoff records;
product-catalogue data, content configurations and product-workflow records supplied by a client; and
security, audit and technical logs needed to operate, secure and troubleshoot the products.

4. Why we use data

We use data to provide and secure proClick AI products, connect services authorised by a client, process and route conversations, create and manage product-content workflows, provide support, respond to demo requests, maintain service records, prevent misuse, and meet legal obligations. A client’s configured rules, approved knowledge and authorised tools determine how its products handle client data.

5. Legal bases

Where ProClick is the controller, processing is based on the performance of a contract or steps requested before entering into one, our legitimate interests in operating and protecting the products, consent where required, and compliance with legal obligations. Where ProClick acts as a processor, the client business is responsible for identifying the appropriate legal basis and providing required notices to its customers.

6. Sharing and service providers

Access is limited to authorised ProClick personnel, the relevant client business and service providers that help us operate the products, such as hosting, security, communication, analytics and AI/automation providers. We use providers under appropriate contractual and confidentiality protections. We may also disclose data where required by law or necessary to protect the security of the products, people or rights.

We do not sell personal data. We do not use a client’s data for purposes outside providing, securing and improving the contracted products unless the applicable client agreement or a separate notice permits that use.

7. Retention

We retain data for as long as needed for the purposes above, the client’s configured retention settings, our contractual commitments and applicable legal requirements. Client data is normally deleted or returned under the client agreement when the relevant service ends, subject to limited retention needed for security, dispute resolution or legal obligations.

8. International transfers and security

Where processing involves a transfer outside the European Economic Area, we use an applicable transfer mechanism and appropriate safeguards. We use technical and organisational measures designed to protect data, including access controls, role-based permissions, logging and secure transmission. No system can guarantee absolute security.

9. Your rights and deletion requests

Subject to applicable law, you may request access, correction, deletion, restriction, objection or portability. You may also complain to a competent data-protection authority. For data handled for a client business, we may need to direct your request to that client or assist it in responding.

We may request information necessary to verify the request. Where GDPR applies, requests are handled without undue delay and ordinarily within one month, subject to permitted extensions or exceptions.
